Ellis County Observer website publisher Joseph G. "Joey" Dauben could make bond soon, but he won't be returning to live on Cedar Creek Lake while he awaits trial on sexual abuse of a child charges.
Dauben's bond was reduced to $50,000 from $200,000 on March 2, but the Navarro County court set conditions on his release that include requiring him to live in either Navarro County or Ellis County. When Dauben, 31, was arrested and arraigned on the charges Dec. 19 he lived and worked from a home office in Payne Springs.
Dauben's grandparents lived on Cedar Creek Lake when he was growing up.
The blog publisher's mother, Cheri Hackler Dauben, said in a telephone interview she expects her son will soon be released on bond, but she is unsure where he will live. He cannot live in his family's Ellis County home because it is too close to a church that runs a daycare center, she said.
In addition to the county residence requirement, Dauben is prohibited by the court from being within 200 yards of any place children are known to congregate.
"We are trying to figure out where he is going to live," Mrs. Dauben said. "I can't believe he can't come home."
Other requirements of release on bond include that Dauben wear an ankle monitor, report to a Navarro County probation officer weekly, avoid contact with the alleged victim, refrain from Internet use, avoid contact with anyone with a criminal background and refrain from use of alcohol or illegal drugs.
The child sexual abuse charges, to which Dauben has pleaded not guilty, involve a 19-year-old male who was 15 at the time of the alleged sexual assault in 2007. Dauben is charged with four counts of sexual assault that allegedly occurred during one incident on a church camping trip.
Dauben also faces a charge of false use of identifying information in Ellis County that allegedly occurred in connection with his reporting on his website. An Ellis County grand jury returned that indictment Jan. 19 while Dauben was in jail in Navarro County, but no action has been taken on that case pending the outcome of the Navarro County case.
